Passenger Terms of Service
Effective Date: October 7, 2025
1. Contractual Relationship
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Passenger,” “you,” or “your”) and Rides With Purpose, LLC, a Texas limited liability company (“RWP,” “Company,” “we,” “us,” or “our”), governing your access to and use of the Rides With Purpose mobile application, website, and related technology platform (collectively, the “Platform”). By downloading, accessing, or using the Platform, creating an account, or arranging transportation through RWP, you expressly acknowledge and agree to be bound by these Terms, our Privacy Policy, and any supplemental policies referenced herein. If you do not agree to these Terms, you may not use the Platform.
2. The RWP Platform
The Platform enables Passengers to connect with independent contractor Drivers who provide transportation services. RWP does not provide transportation or logistics services and does not operate as a motor carrier, common carrier, or taxi company. Drivers act solely as independent contractors under their own authority. RWP is not responsible for their actions, omissions, or representations.
3. Definitions
“Platform” – the Rides With Purpose mobile app, website, and supporting technology. “Ride” – a transportation trip scheduled and completed through the Platform. “Passenger” – any individual requesting or booking a Ride. “Driver” – an independent contractor using the Platform to provide Rides. “Safety and Security Fee” – a flat fee of $3.00 charged per Ride, used to fund company-wide safety, compliance, and insurance programs. “Donation” – a voluntary contribution made through the Platform to veteran-support initiatives.
4. Eligibility and Payment Method Requirements
You must: (a) be 18 years of age or older to use the Platform independently; (b) if under 18, be accompanied for the entire Ride by a parent or legal guardian; (c) maintain a valid payment method attached to your RWP Passenger Profile, which will be securely processed through Stripe, RWP’s authorized third-party payment processor; and (d) comply with all applicable federal, state, and local laws governing rideshare participation. By adding or maintaining a payment method, you authorize RWP and Stripe to charge that payment source for all fares, tips, fees, donations, and adjustments associated with your Platform activity. RWP does not store full card numbers or sensitive financial data; transactions are encrypted and securely handled by Stripe in accordance with PCI-DSS standards. RWP may suspend or terminate access if payment authorization cannot be verified, the card expires, or a transaction is declined or reversed.
5. Passenger Conduct and Responsibilities
(a) Unaccompanied Minors — Minors under 18 are prohibited from using the Platform without adult supervision. Drivers may refuse service to unaccompanied minors without refund. (b) Car Seats — Passengers are responsible for providing and properly installing legally required child-safety seats. Drivers may refuse service if compliance is not met. (c) Conduct — Passengers must behave respectfully, lawfully, and safely. Harassment, intoxication, or disorderly conduct may lead to suspension or termination. (d) Prohibited Activities — Passengers may not interfere with a Driver, attempt fraud, use the Platform for illegal purposes, damage vehicles, or create duplicate accounts to evade enforcement.
6. Booking, Cancellations, and Fees
Passengers may cancel a requested Ride prior to Driver arrival, subject to a possible cancellation fee once a Driver has been dispatched. If a Passenger fails to appear within the Driver’s allotted wait-time window and that timer expires, fifty percent (50%) of the estimated fare shall be charged. Cancellations resulting from Passenger misconduct, failure to provide a required child safety seat, or an unaccompanied minor shall result in the full estimated fare being charged. All cancellation and no-show charges are processed to the payment method on file.
7. Payments and Safety Fees
All fares, tips, cancellation charges, and the flat $3.00 per-ride Safety and Security Fee are processed through Stripe, RWP’s authorized third-party payment processor. The Safety and Security Fee is disclosed to the Passenger before a Ride is booked. By requesting a Ride, Passengers authorize RWP and Stripe to charge the payment method associated with their account for all amounts owed. The Safety and Security Fee funds company-wide safety, compliance, and insurance programs and is separate from the fare paid to the Driver.
8. Donations
Passengers may voluntarily add a donation to their Ride to support veteran-homelessness initiatives. All donations collected through the Platform are directed in full to Mu Beta Phi Military Fraternity, Inc., RWP’s verified veteran-support partner. Donations are voluntary and non-refundable. RWP publishes periodic transparency reports on donation use.
9. Dash Camera and Safety Policy
Drivers on the Platform are strongly encouraged to operate dual, forward- and interior-facing dash cameras (e.g., Vantrue N4, Nexar Pro, BlackVue DR900X). By entering a Driver’s vehicle, Passengers consent to being recorded. Footage may be reviewed by RWP in connection with the investigation of safety incidents or Passenger/Driver complaints.
10. Cleaning and Damage Fees
Passengers are financially responsible for any damage, spills, or contamination of a Driver’s vehicle caused during a Ride, including damage requiring professional cleaning. RWP will assess a cleaning or damage fee, generally ranging from $25 to $250 depending on severity, based on the Driver’s report and supporting evidence (e.g., photographs). Cleaning and damage fees are non-refundable and are charged to the payment method on file.
11. Refunds and Adjustments
RWP’s refund policy is limited to verified overcharges, duplicate charges, or billing errors. Refunds are not issued for completed Rides, cancellation charges properly assessed under Section 6, or donations. Passengers who believe they were charged in error should contact RWP at info@rwpapp.com.
12. Account Suspension or Termination
RWP may suspend or terminate a Passenger’s account, without prior notice, for violation of these Terms, safety concerns, suspected fraud, harassment of a Driver, or misuse of the Platform. A Passenger may deactivate their own account at any time through the Platform or by contacting RWP.
13. Commitment to Accessibility
RWP is committed to complying with the Americans with Disabilities Act (ADA) and applicable state accessibility laws. Service animals and legally recognized emotional support animals are permitted in accordance with applicable law, and Passengers may request accessible-vehicle accommodations where available on the Platform.
14. Limitation of Liability
To the fullest extent permitted by law, the Platform is provided “AS IS” without warranties of any kind, express or implied. RWP, its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising from use of the Platform. RWP’s total cumulative liability to a Passenger shall not exceed $100 or the total amount paid by that Passenger to RWP within the preceding twelve (12) months, whichever is greater.
15. Intellectual Property Ownership and License Restrictions
RWP grants Passengers a limited, non-transferable, revocable license to access and use the Platform for personal, lawful purposes. All software, trademarks, logos, and other intellectual property associated with the Platform belong exclusively to RWP. Unauthorized reproduction, distribution, or derivative use is strictly prohibited.
16. User Data and Privacy Rights
RWP’s collection, use, and disclosure of Passenger information is governed by the RWP Privacy Policy, available at rideswithpurpose.com/privacy-policy/, which is incorporated into these Terms by reference.
17. Notices and Electronic Communications Consent
Passengers consent to receive all notices, disclosures, and communications from RWP electronically, either to the email address associated with their account or via postings on the Platform. Such notices are deemed received upon dispatch.
18. Limitation of Claims and Survival
Any claim or cause of action arising out of or related to use of the Platform must be filed within one (1) year after the claim or cause of action arises, or it shall be permanently barred. Provisions of these Terms that by their nature should survive termination — including payment obligations, liability limitations, and dispute-resolution provisions — shall survive.
19. Force Majeure
RWP shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including natural disasters, war, acts of terrorism, labor strikes, or internet or telecommunications outages.
20. Entire Agreement, Severability, and Assignment
These Passenger Terms, together with the RWP General Terms of Service and Privacy Policy, constitute the entire agreement between the Passenger and RWP and supersede all prior discussions, proposals, or representations. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. RWP may assign its rights and obligations under these Terms without restriction; Passengers may not assign their rights without RWP’s prior written consent.
21. Dispute Resolution and Governing Law
These Passenger Terms incorporate by reference the arbitration and governing-law provisions of the RWP General Terms of Service: disputes are resolved through binding arbitration administered by the American Arbitration Association (AAA) in Bexar County, Texas, with each party waiving the right to a jury trial or class action, and these Terms are governed by the laws of the State of Texas and applicable U.S. federal law.
